Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Famino mobile application (the "Service", "App") operated by Daniel Prause ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
Famino is a family organization app designed to help families plan their daily lives together. The Service includes the following features:
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. You create an account by using Google Sign-In. You are responsible for safeguarding the Google account that you use to access the Service and for any activities or actions under your Google account, whether your Google account is with our Service or a third-party service. You agree not to disclose your Google account password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Famino is based on a family system. Each user belongs to exactly one family. Without family membership, the App cannot be used. You can create a new family or join an existing family using an invitation code.
Parents and owners can create child accounts without a separate email address. These accounts are managed by the creating parent and have no independent login capability. The creating parent is responsible for the use of these accounts.
Famino offers a free tier (Free) with limited functionality and paid subscription plans (Premium) that provide access to enhanced features.
New users automatically receive a 14-day free trial with Premium features upon registration. After the trial period expires, the account is reset to the Free tier unless a Premium subscription is purchased.
Users can earn up to 365 days of Premium bonus time through the referral program. Each successful referral grants 14 days. Bonus time can coexist with an active subscription.
Subscriptions are billed through the Google Play Store or Apple App Store and are subject to their respective terms and conditions regarding payments, auto-renewal, cancellations, and refunds. We do not process payments directly nor store your payment card information.
We reserve the right to modify subscription fees or features at any time. Changes will not affect an existing active subscription term.
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Famino App on devices (Android, iOS) that you own or control, solely for your personal, non-commercial use for family organization as described in Section 1, strictly in accordance with these Terms.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time. Upon termination, you must cease all use of the App and destroy any copies of the App in your possession.

The Service and its original content (excluding User-Generated Content), features, and functionality are and will remain the exclusive property of Daniel Prause and its licensors. The Service is protected by copyright, trademark, and other laws of Germany and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
You retain all ownership rights to the calendar events, tasks, expenses, image attachments, comments, and other content you create or input into the Service ("User-Generated Content").
By using the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User-Generated Content solely for the purposes of operating, providing, and improving the Service. This includes storing your data on our cloud infrastructure (Firebase) and synchronizing it across your devices.
You are responsible for regularly backing up your User-Generated Content. While Famino utilizes cloud synchronization, we are not liable for any loss or corruption of your data.
Famino utilizes third-party services to provide its functionality, including:
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
We reserve the right to discontinue the Service at any time. Upon discontinuation of the Service, access to your data will no longer be possible, and we assume no liability for the loss of your data.
If you wish to terminate your account, you may discontinue using the Service and can request the deletion of your account data by contacting us at support@codamigo.com.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
DANIEL PRAUSE DOES NOT WARRANT THAT: A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURELY, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.
WE DO NOT ASSUME LIABILITY FOR DATA LOSS. ALTHOUGH WE IMPLEMENT REASONABLE SECURITY MEASURES, DATA LOSS MAY OCCUR FOR WHICH WE ARE NOT LIABLE.
IN NO EVENT SHALL DANIEL PRAUSE, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
You agree to defend, indemnify and hold harmless Daniel Prause and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account, or b) a breach of these Terms.
These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
